      停工留薪期的期限是根据定点医疗机构出具的伤病情诊断意见确定,一般不超过12个月。如若住院,一般会根据出院时间确定。因伤情严重或者情况特殊,也可申请延长停工留薪期,经鉴定委员会确认,可以适当延长,但不超过12个月。停工留薪期是《工伤保险条例》规定的一个概念,是指职工因工作遭受事故伤害或者患职业病需要暂停工作接受工伤医疗,原工资、薪水、福利、保险等待遇不变的期限。

      停工留薪期内,原工资福利待遇不变,由所在单位按月支付。原工资《工伤保险条例》未定义,各地规定大致有以下三种计算方法:

      1、遭受事故伤害前加班费之外的工资(河南省人力资源和社会保障厅《关于工伤保险若干问题意见》);

      2、受伤前12个月平均工资(《广东省工伤保险条例》);

      3、受伤前12个月加班费之外的平均工资《浙江省高级人民法院民一庭 关于审理劳动争议纠纷案件若干疑难问题的解答(2012.12)》。

      

    停工留薪期一般不超过多少个月

     

      停工留薪期是指由于某些原因而停止工作一段时间,但工资仍按照原工资标准支付,此时的工资就称为停工留薪。根据国家相关法规和规定,停工留薪期一般不超过3个月。为什么规定停工留薪期不超过3个月呢?一方面,对于企业来说,拖长停工留薪期会增加企业的经济负担,影响企业的正常运转。另一方面,如果停工留薪期过长,也会影响员工的稳定性和心理健康,从而影响到企业的生产效率。停工留薪期是由企业和员工之间协商的结果,通常是在劳动合同中规定的。如果员工需要延长停工留薪期,需要向企业提出申请,并说明理由,企业会根据实际情况进行处理。但要注意,如果超出3个月,企业就不再按照原工资标准支付工资,而是按照法规规定的比例支付。除了规定的3个月停工留薪期外,企业和员工还可以通过加班、调休等方式来弥补因停工而损失的工资。同时,在签订劳动合同时,员工也应该仔细阅读并理解其中的条款,避免因为不了解规定而产生不必要的争议。因此,员工在遇到停工留薪情况时,应该了解相关规定,通过与企业协商达成双方满意的解决方案。
